PRESENTAZIONE CORSO
This course provides a comprehensive introduction to international arbitration, focusing on procedural and substantive issues. It will culminate in the practical application of skills during the Moot court.
Special sessions include:
– a meeting with lawyers from LCA Law Firm,
– a visit to the Chamber of Arbitration of Milan (CAM) and
– a moot court based on the 2025 Vis Moot Case.

The Vis Moot Case serves as an excellent instrument for learning because it provides a realistic arbitration scenario based on a current and complex international commercial dispute. By analysing and discussing this case, students gain a deeper comprehension of the key principles and practices in arbitration, including procedural and substantive issues, while also developing practical skills such as oral advocacy, case analysis, and legal research. The use of this case allows students to experience the application of international arbitration in a way that theory alone cannot provide.

  • Thursday, 10 October
    11:00 – 13:00 – Introduction to International Arbitration
    – Overview of Arbitration vs. Litigation
    – Introduction to Major Arbitration Institutions (ICC, LCIA, ICSID)
    15:00 – 17:00 – The Arbitration Agreement
    – Importance of Arbitration Clauses
    – Jurisdiction and Pathological Clauses
  • Friday, 11 October
    11:00 – 13:00 – Analysis of the Arbitration Agreement
    -Detailed analysis of key clauses
    – Jurisdictional issues and challenges
    15:00 – 19:00 – Analysis of the 2025 Vis Moot Case
    – The 2025 Vis Moot case will be officially released in the morning; the
    class will have the chance to read it for the first time. The case will be
    analysed and explored in its procedural and merits issues as they arise:
    this session will introduce the case and encourage students to think
    critically about how to address the problems posed.

    – Procedural and substantive issues arising from the 2025 Vis Moot case

    – Arbitrator selection and conflicts of interest
    – Additional procedural issues from the 2025 Vis Moot case
    19:00 – 21:00 – Arbitration Proceedings & 2025 Vis Moot Case
    – Pre-hearing procedures, interim measures, and document production
    – Exploring the merits of the Vis Moot case

    15:30 – 18:30 – Oral Advocacy and Moot Court Preparation
    – Effective oral advocacy in arbitration
    – Practice sessions and feedback for the moot court

 

  • Thursday, 17 October (in Milan)*
    9:30 – 13:00 – Moot Court (2025 Vis Moot Case)
    – Held at LCA Law Firm offices in Milan; LCA sponsors and supervises
    the University of Pavia’s Vis Moot team
    – Lawyers from LCA will serve as arbitrators and provide real-time
    feedback
    15:00 – 18:00 – Visit to the Chamber of Arbitration of Milan (CAM)
    – Introduction to CAM’s arbitration and mediation services
    – Workshop on legal research using CAM’s Research and Documentation Centre
